These General Terms and Conditions of Sale (GTC) govern sales concluded on the website https://articlecuisine.fr (hereinafter the "Site"), operated by M.G AUTO, to consumer or business customers placing orders online. Any order implies unreserved acceptance of these GTC, which prevail over any other document unless otherwise agreed in writing.
The Site offers kitchen and tableware items selected under the editorial brand "Article Cuisine". Photographs and descriptions are indicative; slight variations may occur depending on batches or manufacturers. Offers are valid while stocks last. If a product becomes unavailable after an order is placed, the customer will be notified and may request cancellation and a refund for the affected product.
Prices are shown in euros, inclusive of all taxes (VAT included) for customers located in France, unless otherwise stated. Delivery charges are displayed before payment is confirmed. M.G AUTO reserves the right to change its prices at any time; the price charged is the price displayed when the order is confirmed.
The customer selects products, enters delivery and billing details, chooses a delivery method, then confirms the order after accepting these GTC. A confirmation email summarises the order. M.G AUTO reserves the right to refuse or cancel any order in the event of a prior dispute, manifest error, or suspected fraud.
Payment is made online by bank card through the payment provider Stripe. The card is charged when the order is confirmed. Card data is processed securely by the provider; M.G AUTO does not have access to full card details. If payment is declined, the order is automatically cancelled.
Products are delivered to the address or pickup point specified by the customer. Applicable lead times and rates are shown before payment. Risk of loss or damage to the products passes to the customer upon handover of the parcel. In the event of a significant delay, the customer may contact customer service at contact@articlecuisine.fr.
In accordance with Articles L.221-18 et seq. of the French Consumer Code, consumer customers have 15 days from receipt to exercise their right of withdrawal without giving reasons or incurring penalties (excluding any return shipping costs). Practical terms (eligibility, procedure, refund) are set out on https://articlecuisine.fr/service/retours. Unsealed hygiene-related or personalised products may be excluded as permitted by law.
Products benefit from the legal conformity warranty (Articles L.217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code). In the event of a defect, the customer has two years from delivery of the goods to take action. Any non-conformity should be reported to contact@articlecuisine.fr with the order number and, where applicable, photographs.
M.G AUTO shall not be liable for failure to perform the contract in cases of force majeure, acts of third parties, or improper use of the product. M.G AUTO's liability, on any grounds whatsoever, is limited to the amount of the order concerned, unless mandatory legal provisions provide otherwise.
In the event of a dispute, the customer may contact customer service at contact@articlecuisine.fr. Failing amicable resolution, consumers may use a consumer mediator free of charge in accordance with Articles L.612-1 et seq. of the French Consumer Code. European Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr. Failing amicable mediation, the French courts shall have jurisdiction under ordinary rules of law.
These GTC are governed by French law. The language of the contract is French. If any clause is held invalid, the remaining provisions shall remain in full force and effect.
